EMP/OMP Library - Scope

EMP/OMP Library

The EMP/OMP Library consists of two sets of customer terms - separate terms for:

  • market counterparties (MCTs)
  • intermediate customers (ICTs)

The EMP/OMP Library covers only dealing in designated investments (as specified below), arranging deals in those investments, and advising on those investments. Other types of investment activity (e.g discretionary management of investments) may have specific client documentation requirements which are not covered.

The terms cover the following product range:

  • OTC energy derivatives (including forwards)
  • contracts for differences (including those that are energy related)

The documentation meets mandatory UK regulatory requirements for client documentation in the above business and product areas, for firms which are EMPs or OMPs (including those with no waiver of capital requirements).

The EMP/OMP Library is not designed to meet the requirements of any other overseas jurisdiction in relation to products traded within that jurisdiction or for business with clients located there.
