FOA Regulation

The role of the FOA in the area of regulation is to address international, European and domestic regulatory policy, rules and procedures to the extent that they affect the wholesale markets/derivatives business carried on by its members. It involves the development of position papers, active lobbying and individual briefings. In carrying out this function, the FOA enjoys the support of a number of practitioner-based standing committees and working groups (covering particularly compliance, financial regulation, clearing and settlement, risk, commodities and energy markets) and ad hoc working parties formed on an “as needed” basis. Any member interested in participating in the work of these committees should contact the FOA.

The core of the FOA’s work is currently focussed on the European Commission’s plan for completing the single market in financial services and ongoing changes to the UK regulatory structure and rules. A list of all recent FOA position papers is set out below, although it should be noted that the FOA restricts its written responses to address only those matters which are relevant to the membership. FOA papers in draft form are available on request from the FOA by any of its members.

In addition to the above, there are a number of projects which are not directly a part of the FOA’s regulatory role, but which are strongly related to it, for example:

A set of legal opinions will be produced to cover the rights and conditions of market / trading access in commodity derivatives across a number of EU and non-EU jurisdictions identified by member firms.Full details are provided in the attached outline. Click here

The FOA also responds to individual confidential requests by firms for information, guidance and assistance on regulatory issues and, where appropriate, makes discreet “no names” enquiries of regulatory authorities and exchanges both in the UK and overseas in seeking informal guidance, for example, on the interpretation of particular rules.
